DOJ and Affirmative Action

Early October it was announced that the Department of Justice (DOJ) is taking on Affirmative Action.  The DOJ is targeting Harvard University and the University of North Carolina.  Lest no forget that the United States Supreme Court had just ruled against this type of suit at the University of Texas, where the majority opinion written by Justice Kennedy, “said courts must give universities substantial but not total leeway in designing their admissions programs.

“A university is in large part defined by those intangible ‘qualities which are incapable of objective measurement but which make for greatness,’” Justice Kennedy wrote, quoting from a landmark desegregation case. “Considerable deference is owed to a university in defining those intangible characteristics, like student body diversity, that are central to its identity and educational mission.”  (NY Times – June 23, 2016)

The irony of this action is that they are using the Civil Rights division of the DOJ to go after these institutions of higher learning.  Also, lets understand that this is calculated.  What do I mean?  Here is my understanding of these two schools. First of all, one school is private, whose pedigree makes it one of the greatest institutes in the world. The other school is the flagship of the state of North Carolina, is a public school. Secondly, one school reside in the north, the other school resides below the Mason-Dixon line.  Thirdly, this investigation will be, mostly, run out of the front office. That is where the political appointees are stationed.  The back office is where the career DOJ employees work.

What we must understand and be sure of, is that these cases will continue. The attack on Affirmative Action will grow stronger, especially under this administration. We must be ever vigilant in watching what is going on in these United States.  Where is the Watchman?  Who is crying out to inform the people?
